By way of example, this past December my client went into escrow that required the closing to occur in three weeks, prior to year-end (to save nearly $500,000 on the seller’s increased excise tax if it closed in 2020). Jerry and Audrey quickly determined that extensive drilling would be necessary due to two potentially extensive sources of environmental contamination on the property, due to former uses. The property is a retail center that is extremely busy during the holiday’s but somehow, they managed to find a drilling company to drill numerous test wells in extremely tight quarters (starting a 9PM) and coordinated with the tenants to amazingly agree to open their stores and drill thru the night to obtain the answer whether contamination existed on-site.
The complexity of defining where and how to conduct these tests cannot be overstated! They further expedited the lab testing and conclusively proved that no contamination existed on the property. In my experience of over 40 years in commercial real estate, no other environmental firm would have the expertise, the ability to think outside the box to accomplish the answers in such a short amount of time, nor even the willingness to consider trying to pull off what the buyer, the seller’s, the attorney’s, and yes even myself, said was a miracle and/or impossible.
